4.1. Basic rights & basic rules

Elze's picture
Uitgangspunt:

To be righteous is the foundation of society. That means be honest, incorruptible and trustworthy. On this basis, the basic rights: right of choice, self-determination rights, participation rights and speaking rights shall be jointly founded as a legal identity-right. The regulation is based on the degree of justice. The more reliable humans, animals and nature, the less regulation is needed. As more people are intrinsically fair and extrinsically open about it - whatever the circumstances - the world becomes more reliable.

4.1.1. Basic rights

Right to choose    On condition of not damaging themselves and others, every individual has the right to make, to manifest and to live up to its own choices. As part of the society each identity has the right to make cultural and political choices, if not damaging to themselves and others.

Self-determination right    On condition of not damaging themselves and others every individual has the right to self-determination and right of say over itself. As part of the society each identity has the right of co-determination on common affairs, if not damaging to themselves and others.

Participation right    On condition of not damaging themselves and others every individual has the right to both, on self-chosen [not damaging] way participate in and contribute to position and humane developing of the world society, as others – via family law, education law, employment law and public law – nominate in order to perform, control and maintain, on his or her behalf, managing and/or supporting tasks.

Right to speak    On condition of not damaging themselves and others every individual has the right to shape and pronounce an personal opinion. As part of the society each identity has the right on voice on common affairs, if not damaging to themselves and others.

Identity right    On condition of not damaging themselves and others every individual has the right to be a self choosen identity with own preferences and choices, self choosen [pre-] values and way of living, self choosen interests and activities, and self shaped views and presentations of all that.

Group right    On condition of not damaging themselves and others every individual has the right to create a family, group, organisation, culture or [political] party, together with others, and as such – as a group-identity – to go public, if... on a voluntary basis and the fundamental rights of each individdual seperately not will be violated. [By – whether or not via [the course] manipulation, brainwashing, pressure, [and/or] under the title democraty, that is 'self' choosen – based on a 'together we stay strong, together we can beat others' motive, create a law of the jungle majority.

Information right    As well on condition of not damaging themselves and others, as on condition of identity-right and protection-right, every individual has the right on that information, which he or she considers necessary, and/or want to supply; whether or not in the interest of creating and maintaining of themselves and others not damaging individuals and a ditto world-society. It is the responsiblity of every individual and group themselves, to investigate to what extent these information is founded on veriable facts and to what extent on presumptions, interpretations, maipulations, and fantasy or lies.

Protection right    On condition of not damaging themselves and others, or only to damage as little as possible, every individual has the right to protect both themselves and others, if they are jeopardised. It's the responsiblility of every individual themselves to be alert for and, if it's all posible, preventing of potential risks, nature disasters, agressive reactiona and calamities.

4.1.2. Basic rules

Fair 'traffic rules'    Grown out to an intrinsically motivated identity [see 2.3] is a toddler step compared to attuning extrinsically so carefully, that no violence is done to both your own identity as that of others. Both in the short and the long term. That's why at any time, long ago, societal traffic rules came into existance. Just look at our cosmic example, to all movements in our planetary system and all that meteorites that wander in the cosmic space and as a falling star [flash] end up on our and other planets. If everyone wants to be free to go on without damaging others, or to be damaged, traffic rules are necessary and space and self steering possibilities to deviate from your course, if another is heading your way perpendicular, because he or she can or will not direct or correct themselves. Through childish obstinacy, mental and/or physical inability or because he/she intrinsically hasn't [no longer] a self-employed self-steering-program, and like a zombie extrinsically are being driven by egoists and cultures who have designed a living computer-game of it to direct others in the direction they want. To prevent that an identity loses his or her zelf-steering capacity and like an fallen 'star' themselves and others meteoritic let damage, torpede and/or saddling up with an short-tempered [meteorites] power, all regulations have to be based on justice [in Dutch also to translate as the right (law) skills]. And therefore on jointly defined 'traffic rules' which, where needed, jointly can be modified. And therefore on intrinsically driven identities who know how you literally and figuratively can move on without coming in collision with others. Who know how to avoid being a ghost driver. Who know how to deviate save and righteous from your direction, if others provoke an conflict by encountering you like a ghost driver. Without mentally and physically get off your righteous balance, losing sight of your intrinsic goal or to crash with a third one.

Respect for personel boundaries.    From diverse scientific investigation has been found that each identity needs a minimal space around them to move and develop freely and savely. In 'The Hidden Dimension' the anthropologist Edward T. Hall makes clear which minimum limits is required for animals and humans:

a)
Intimate space – nearby:
touchable

b)
Intimate space – far away:
6 – 18 inch
[15,24 – 45,72 cm]
c)
Personal space – nearbyj:
1,5 – 2,5 feet
[45,72 – 76,2 cm]
d)
Personal space – far away:
2,5 – 4 feet
[76,2 – 121,92 cm]
e)
Social space – nearby:
4 – 7 feet
[121,92 – 213, 36 cm]
f)
Social space – far away:
7 – 12 feet
[213,36 – 365,76 cm]
g)
Public space – nearby:
12 – 25 feet
[365,76 – 762 cm]
h)
Public space – far away:
> 25 feet
[> 762 cm ]

Hall decribes what the agressive and destroying consequenses may be if we feel threatened in our intrinsic and incentric identity space and self-government. Either because we as subsystem of a extrinsic operating system have to reorder for the sake of newcomers, either because others literally and/or figuratively are going to stand too close or too far from us, or to all at once. To avoid unnecessary frustrations and clashes and with regard to the interaction between each other, the residential and living environment, the society as a whole, and the arrangement of the earth concerning the devision of the space for people, animals and nature, we keep calculating with our personal limits as formulated in above mentioned investigation of Edward T. Hall.

Giving insight into cause and effect.    Righteous regulation is based on intrinsic knowledge of right and wrong. Without intrinsic knowledge of right and wrong no intrinsic justice. Not to mention extrinsically. Only if you intrinsically know what are straight and crooked ways and reasonings, you can think about right and wrong. And only if you have thought about good and evil, if you intrinsically have sorted out good and bad elements, you can make incentric choices. Choices which have consequences both intrinsically to yourself as extrinsically to others. Choices that give you an eccentric face; that's you: your incentric choices, based on your intrinsic considerations of good and evil, of straight and crooked considerations, arguments and choices. For this reason, all regulationshave to be focussedon:

  1. making people aware of the differences between intrinsic motivation without consideration of others, and intrinsic motivation with comprehension for and acknowledgement of the needs and rights of others. And more, of the consequences of both on short and long term.

  2. making people alert to their intrinsic thought process and extrinsic way of acting and co-responsibility as regards the world-society.

  3. in a righteous way setting of assertive limits to selfishness and short term thinking.

  4. giving a clear field to and stimulation of humane insights, developments and information.

Humane perspective for everyone.    The way to humane perspective for everyone begins by each person personally. With [learn] to know your boundaries, know where your power is ending and that of another begin and accept that.

  1. If your starting point is not damaging and your self-protection founded on reasonableness you have a good base to develop youself the way you want.

  2. Only if you can distance yourself from unreasonable views you are capable of senso-motoric focusing on all the positive around you.

  3. You are only really liberated from damaging influences from past and present if you see through the historical patterns and these break through humane.

  4. The big challenge for every human being is and remains to keep signaling damagers, and damages and damaging behavior in yourself and others – whether or not in a nice packed facade – and there, as much as possible, not damaging, but assertive self-protectively keep reacting to.

4.1.3. Basic structure

BASIC PRINCIPLES:  Humane rights for everyone, human, animal and nature.

  1. Most important principle:  The first and most important basic principle is not to damage yourself and others, or, in the context of self-defense and protect each other, as less as possible.

  2. One after most important principle: On this first basic principle the basic rights of human, animal and nature, as formulated in 4.2.1, are based

  3. Two after most important principle: All other regulations are subordinate to the above-mentioned basic principles.

  4. Three after most important principle: The judiciary oversees compliance.

FORM OF STATE:  Federal republicon a world scale.

  1. Highest Body:  UN= Planetairylevel / world

  2. One after highest Body:  States= internationallevel / part of the world

  3. Twafter highest Body:  Federal state= national level / countries

  4. Three after highest Body:  City-state= locallevel / regions.

FORM OF GOVERNMENT:  Humane democrac[humanocracy]. Consists of Indirect+ direct democracy

  1. Highest Body:  Political Judiciary

  2. One after highest Body:  Direct elected Federal Parlement [legislature power]

  3. Twafter highest Body:  Non-binding Referenda [advisory power]

  4. Three after highest Body:  Governing Power [executive power]

  5. Four after highest Body:  Supportive Power [power public employees]

JURISDICTION: Humanjurisdiction for everyone, human, animaland nature.

  1. Most important starting point: We all have the right to self-determination and control over ourselves, and speaking rights, but only on condition of attuning carefully, without damaging yourself and others.

  2. One after most important starting point: To be righteous is intrinsically - that is, without that another must alert you for that;out of your genetic supplied and from a within developed sense of justice - be conscious how, in a reasonable, honest, incorruptible and reliably way, you can deal with the opportunities and skills which are [really] available to you, and extrinsically can act towards it, without damaging yourself and/or others or to do short.

  3. Two after most important starting point: Every human being must learn to build on own sense of justice and responsiblility in every circumstance. So learn to respect the right of say and identity limits of themselves and others. So learn not to tolerate themselves and others blocking or damaging behaviour and resist in a righteous way. So learn what is good and evil and are straight and crooked reasonings. The earlier the better, but better late than never.

  4. Three after most important starting point: Every human being has at all times right on the crucial judicial protection, wherever he or she is unable to do so in a reasonable way itself.

4.1.4. Basic information

To ensure a righteous, democratic society a veracity and independent information services shall be regulated and by all citizens of the world are being checked and guaranteed.

The informatio services on the internet is – on condition of not damaging of yourself and others – available for everyone.

Everyone had the right on inspection of documentation which concerns him or herself.

Withholding relevant information for the benefit of yourself and certain groups, organisations and governments and to the detriment of others [hidden agendas and backroom politics] are damaging and undemocratically and therefore intolerable. Think of:

  1. Political, scientific, cultural and business information that affects the safety of the Earth and its inhabitants.

  2. Political, scientific, cultural and business information that affects the public health of everyone, or certain groups.

  3. Political, scientific, cultural and business information that affects the democracy and public participation of world citizens.

  4. Political, scientific, cultural and business information that affects the privacy of world citizens.

  5. Political, scientific, cultural and business information that affects the individual right of say of world citizens or certain groups.

  6. Political, scientific, cultural and business information that affects the development opportunities of world citizens.

  7. Political, scientific, cultural and business information that affects the participation-rights of world citizens or certain groups.

  8. Political, scientific, cultural and business information that affects the reciprocal attunement and co-operation of world citizens.
